How to Fax an FMLA Medical Certification
How to return an FMLA medical certification to the employer, protect health information, and keep proof that the form arrived on time.

An employer may ask for a medical certification to support leave under the Family and Medical Leave Act. The certification goes back to the employee or employer, not to the US Department of Labor.
Fax can be a practical return method when the employer provides a secure human resources or leave administrator number. Confirm that destination instead of sending medical information to a general company fax.
Use the employer’s instructions or an accepted form
The Department of Labor publishes optional FMLA certification forms, including WH-380-E for an employee’s serious health condition and WH-380-F for a family member’s condition.
An employer may use its own form, but Department of Labor guidance says it must accept a complete and sufficient certification in another format when it contains the required information. Ask the employer which form and submission route it prefers.
Watch the deadline
Employers generally must allow at least 15 calendar days to return a requested certification, unless it is not practicable despite diligent, good-faith efforts. The employer’s notice should state the deadline.
If the clinician cannot complete the form in time, tell the employer or leave administrator before the due date. Keep a record of that communication.
Prepare the fax
- Confirm that the employee and clinician sections are complete.
- Check signatures, dates, treatment estimates, and intermittent-leave details.
- Call HR or the leave administrator to verify the fax number.
- Use a confidential cover sheet with the employee name, case reference, and total pages.
- Avoid repeating diagnosis details on the cover sheet.
- Scan the form as a readable PDF and fax it once.
- Save the final form and transmission report.
Only provide the health information requested by the certification. The direct supervisor generally should not contact the health care provider for clarification. The employer’s authorized HR, leave, management, or health professional handles that process under FMLA rules.
Confirm the certification is complete
Ask the leave administrator whether the packet arrived and whether anything is missing. A fax report does not prove the employer considers the certification complete. If the employer identifies a deficiency, it should explain what needs correction and provide an opportunity to cure it.
